Court News - Mumba vs MCP and Mkandawire matterย Ajourned
The High Court in Mzuzu has adjourned the matter between Vitumbiko Mumba (Claimant) and Malawi Congress Party and Adamson Joseph Kuseri Mkandawire (Defendants) to 15th July, 2025 at 14:00 hours for judgement.
The claims being advanced by the Claimant through the court are as follows:
A declaration that under the 1st Defendantโs Constitution, the Defendantโs National Executive Committee and or the Regional Chairman has no authority to appoint electors in a primary election.
A declaration that people who hold elected offices within area committees of the 1st Defendant cannot be omitted from a list of electors of primary election.
A declaration that the 1st Defendant cannot resile from an agreement that was reached between itself and all the aspirants for the 1st Defendantโs candidacy for Mzimba Central Constituency in the parliamentary elections to be held in September 2025, on the electors that would participate in the primary election.
A declaration that the purported primary election which the 1st Defendant held for its parliamentary candidate for Mzimba Central Constituency on 11 May 2025, in which the 2nd Defendant was declared a winner, was a nullity.
An order compelling the 1st Defendant to conduct a fresh primary election for election of the 1st Defendantโs candidate to contest in the parliamentary election set for September 2025, In Mzimba Central Constituency, using the 2018 electoral college as agreed by all participating candidates and in a manner that conforms to democratic principles, transparency, fairness and accountability.
Costs of this action.
This case, which is being handled by Justice Justus Kishindo, began in May 2025 with an injunction. The injunction was initially granted to the Claimant but was later vacated by the Defendant. Justice Kishindo, then, ordered an inter partes hearing.
