David P. Banda V Attorney General (MEC) - Application Dismissed

Election Case No. 12 of 2025 - Before Hon. Justice Bruno Kalemba

The High Court of Malawi has dismissed an application by David P. Banda seeking an interlocutory injunction to restrain the announcement of parliamentary election results for Lilongwe Mpenu Constituency. Banda alleged anomalies in the 16th September 2025 polls and requested a vote recount, but the Court held that his application was based on an unsubstantiated assumption that the Commission would not procedurally address the Claimantsโ€™ complaint. It further stated that refusal to grant the interlocutory injunction will not result in irreparable damage to the Claimantsโ€™ case, as he has recourse to section 100 of the Presidential, Parliamentary and Local Government Act, which provides for appeals to the High Court where a party is dissatisfied with the decision of the Commission.
