Judiciary and BAM hold Inagural Workshop on Balancing Justice and Commerce

The Honourable the Chief Justice of the Republic of Malawi, Honourable Justice Rizine Mzikamanda, SC, has today in Mangochi officially opened a two-day workshop themed “Balancing Justice and Commerce: The Impact of Court Injunctions on Malawi’s Financial Sector and the Broader Economy."

The workshop, jointly organized by the Judiciary Training Committee and the Bankers Association of Malawi (BAM), has brought together Judges from the Commercial Division of the High Court, legal practitioners, and representatives from Malawi’s financial institutions to deliberate on the intersection between judicial processes and economic stability.

In his opening remarks, the Chief Justice underscored the importance of collaboration between the Judiciary and key players in the financial sector to enhance the delivery of commercial justice.

The role of the courts in commercial justice is to provide a framework for resolving disputes as well as enforcing commercial contracts and fostering economic activity through fair and efficient legal processes.

The Chief Justice stated that the Judiciary remains committed to the rule of law, to principles of justice and to principles of fairness. He emphasized that while the Courts play a pivotal role in upholding the rule of law, they at the same time bear the responsibility to allow commerce to thrive freely within the broad parameters set by the legislature and public policy. The Chief Justice added:

We get troubled when we hear complaints about the negative impact of court injunctions on Malawi’s financial sector. But we have committed ourselves to being a responsive judiciary. A responsive judiciary that engenders public confidence.

Delivering her remarks, Bankers Association Chief Executive Officer, Mrs. Lyness Nkungula, described the workshop as a milestone in fostering dialogue and understanding between the financial and judicial sectors.

This refresher course has been carefully designed to foster dialogue on emerging trends, deepen mutual understanding between the financial sector and the courts, and promote alignment in our shared pursuit of justice and economic stability.

Chairperson of the Judiciary Training Committee, Honourable Justice Violet Chipao, thanked BAM for initiating the refresher training, providing financial and technical support being a partner in promoting and protecting the banking sector.

Recently, the Judiciary had another engagement with BAM through BAM’s donation of a court recording system at the High Court, Criminal Division in Blantyre.
