The Supreme Court of Appeal, on 16th October 2025, dismissed an application by Mary Bessie Mwale seeking a review of taxation costs against Mzuzu City Council.

The Court held that the application was prematurely filed, noting that the applicant should have first sought review before the Registrar in the Court below, in accordance with the Civil Procedure (High Court) Rules.

Justice of Appeal M.C.C. Mkandawire, SC, emphasized the need to respect established legal imperatives and exhaust all existing legal mechanisms before approaching the Apex Court.

The matter was dismissed with costs.
