The High Court of Malawi issued its ruling in the case of Dr. Lazarus Chakwera and the Malawi Congress Party (MCP) v. Malawi Electoral Commission (MEC), following a challenge on the handling of electoral complaints from the September 16 elections. The claimants sought judicial review of MECโ€™s alleged failure to investigate reported irregularities, including mismatches in tally sheets and the use of photocopied result forms. The Court granted permission for judicial review, but declined to stop the announcement of presidential results, reasoning that the scheme established by the law permits parties/individuals only to challenge the return of election results. Given that the results had not yet been publicly announced, the application seeking to restrain the MEC from declaring the final results was therefore premature.
